| my moms boyfriend bought my lil 8 year old bro a 4 wheeler for valentines day last year and now my mom broke up with that guy and he says since he bought the 4 wheeler he can do whateer he wants with it but since it was a gift can he do that or not or does my lil bro have a right to keep it |

| Sorry, probably not. A 4-wheeler is titled property, in most states. Perhaps yours is different, but probably not. Since your brother is only 8, he cannot legally own it.The machine belongs to the person whose name is on the title.Barring a title, it belongs to your mom until your stepdad gets possession of it. She can sue, based on the gift aspects, but if he has a receipt, it wouldn't be worth it to her. |

| It was a gift, so legally it is the property of your little brother. If the person comes and takes the ATV, it would not be a criminal matter as much as a civil property dispute. Depending on the value of the ATV, your mother would handle the case in either a small claims or circuit civil court. As always, the very best advice is to have your mother consult an attorney who will know precisely what the laws of your state are. |
