My mom passed away in April. Last year in December we went to a cosmetic clinic and she paid for me with a credit card a tummy tuck. She told me: "this is my christmas gift for you" I'm on schedule for the tummy tuck by next month. My question is: The clinic already has the money. The surgery is already paid, but she was paying the credit card. After her death I haven't send any payments to the credit card. I would like to know what is going to happend when the credit bureau finds out that she passed away. Are they going to call to the clinic and tell them to refund the money? If the clinic finds out that she passed away they will refund the money to the credit card? Or there is not a problem because the surgery is already paid? Can somebody with knowledge about law to answer this question please it is very important for me to know where I'm standing. Thanks!

When a merchant obtains an authorization from the credit card issuer, the credit card issuer is guaranteeing payment of that money. It can not be charged back unless there was an instance of fraud, improper authorization procedures, or the customer disputes the charge. Your tummy tuck will go through as scheduled. Your mother's estate is liable for the money owed to the credit card company. Sorry about your loss and enjoy your tummy tuck.
