Your Open QuestionShow me another ยป Ex-husband wants to stop support for his son?ex-husband want to stop support for his son he hasnt paid support for his son since may 5 2008 ,this is when my son went to visit his uncle for the summer but iam sending support to my brother for my son can my ex's support stop because my son is visiting his uncle my ex said too he wanted to stop support because he doesnt have a job ... and my son quit school he is 17 but when he comes back he either goes back to school or night classes my ex-husband hasnt seen his son in 3 yrs. and hasnt bought him any birthday gifts or christmas gifts since he came to live at my residence but now my son is 17 and haveing a little problems and it is all because of him not visiting him and being a dad he feels left out because he has 3 other kids with his wife and 2 more with me and they all get gifts .... except for my son.... can my ex stop support if my son isnt here for the summer months even though iam sending support to my brother on may 5th when he left , will child support be stopped!!!36 minutes ago - 3 days left to answer. Additional Details30 minutes agoiam still supporting my son my brother is gonna write me a letter to the friend of the court i hope they accept it iam the only one right now supporting my son my ex isnt and why isnt the child place more considerate about your feelings29 minutes agoi dont have a lawyer and have to go to court june 11th at 9:00 am20 minutes ago.my exhusband doesnt wanna pay support he told my son's girlfriend who is 25 he almost lost his house because it is too highmy ex husband doesnt call my son or nothing all of a sudden my son was having problems in school and alcohol my ex went with it but he doesnt want his son to live with him AT ALL , sorry iam a paranoid parent i just love my son aloteveryone who answered my question thanks so much!!!

Get a lawyer. You'll need one even though you've done nothing wrong or anything. Trust me.

no he cannot just stop support during the summer. look at child support like a yearly amount that is broken into 12 monthly payments. that is how it works. he is going to lose in court, for sure, no doubt. BTW, you dont need the send the money to the uncle either, that is your choice and a nice thing to do, but not necessary and wont matter to the courts.

does the child support order say the child support stops when 17 year old child goes on vacation without you? if not, child support continues as last ordered by the court until your ex is able to get the court to modify its prior child support order. you should bring proof of your support payments for the child since the child went to live with uncle to court. cancelled checks would be good. first thing you need to do is carefully read the court's orders regarding your son. do you have the right to determine where child lives? if so, you may argue that you've decided its best for child to live with your brother for now because recent problems make you believe the boy needs a strong and loving male role model that you believe your brother can provide in this difficult time. you do not wish to relinquish custody to your brother, and, in fact, plans are now for your son to return to you in fall and start school again. whatever the truth is. both parents of a child have a legal obligation to support the child so long as he is a minor, or until a later time specified by your state's law and/or your court order. it appears the court will examine the circumstances on the June 11 court date. what is your current relationship with your son like? with your bother? depending, it may be useful for one or both to come to court with you to testify as to situation. it is difficult to say what the judge is likely to do under the circumstances you describe, which probably include a volatile or unhappy 17 year old boy. but it is highly unlikely that the court will relieve either or both of his parents from their responsibilities to him so long as he is a minor.
