Pawn shop in California loan term should be 4 months. After 4 months, shop sends out notice to customer giving them an extra 10 days to redeem item if customer hasn't yet to pay for interest or pay off whole loan. Link to law: http://inlandlegal.org/publications/consumer/ENGLISH_Pawn_Shops_Brochure.pdfI pawned gold bracelet on Oct. 22 2007, payed interest til Feb 22 2008. Which equals 4 months, I had an option of paying interest or pay off loan. I paid interest. My loan is suppose to continue for another 4 months, ending June 22, 2008. I didn't go to pay interest in Mar, Apr, May so I went in on June 21st right before my loan term ends to pay interest but note on shop said closed til July 1st. Went in on July 1st, they told me my gold has been sold! Didn't send me notice like law says to. He said he can't do nothing but to offer me an equal item in replace of my bracelet, which is irreplaceable gift from mother. Is it worth it to go to court or take their offer? Item worth 1,000

It may be in your best interest to take their offer. The disadvantage you have is not paying March, April & May even though you had until june.

When you didn't pay interest for almost four months what did you expect the pawn shop to do? They assumed you'd relinquished the item so I don't blame them for selling it. If it was such a sentimental item from your mother, I would have been more diligent in making sure I paid on the item. You can try taking them to court but that won't bring your mothers bracelet back now it's been sold. You'd be better off having him give you a comparable bracelet but it won't be worth $1000 unless you have proof that's how much your mom paid for it.

If it was so irreplaceable, they maybe you shouldn't have pawned it. Just a thought.
