The restaurant changed owners but did not change the name or anything and now they have a notice up saying they will not honor any gift certificates issued before the sale of the restaurant. Is this legal? The restaurant is in Colorado. Thanks

Since it's a completely new restaurant than yeah, they can. The old restaurant made the money and never provided services. The new restaurant is not responsible for taking on the old restaurant's debts.

It really is unfair. Some businesses sell the cards on Monday and go out of business on Tuesday. That seems like fraud. I now use all certificates as fast as possible..

I'm going to suggest contacting the Better Business Bureau and reporting them. when a business changes hands the new company receives the money (is paid for by an individual) for these gift certificates. If this new company doesn't want to honor the certificate I would make a really big deal out of it.Is there a date on the certificate?
